Personal Injury & Wrongful Death

The Impact Of Pre-Existing Injuries On Personal Injury Cases

All experienced attorneys that practice in the personal injury field are familiar with insurance companies attempting to exploit prior injuries sustained by clients. The argument often used is that the injury caused in the car wreck, tractor-trailer accident, slip and fall incident, or other personal injury case was not caused by the negligence of the person being sued, but rather, that the victim of the negligence is simply malingering and/or claiming damages for a pre-existing injury. Insurance companies subpoena health records as far back as

Five Hour Energy Drinks: A Potential Killer

According to the Food and Drug Administration (FDA), it has received reports of 13 deaths associated with the use of the popular “Five Hour Energy” drink. Because the FDA’s investigation is ongoing, currently it is not known what has caused these reported deaths. Is it because the product has too much caffeine that results in heart attacks? Or is it because of other ingredients in the drink which are not subject to FDA regulations (because it is considered a dietary supplement)? The Five Hour Energy

Using The Glasgow Coma Scale To Determine The Severity Of Brain Injury

In many of our serious automobile collision cases we unfortunately find ourselves representing victims of a traumatically induced brain injury. During any serious car accident, unfortunately victims oftentimes strike their heads either on the seat or some other interior portion of the car. This can sometimes result in a loss of consciousness, confusion, dizziness or otherwise. When emergency personnel arrive at the scene of a serious wreck and diagnose those who appear to be confused or dazed, they typically use an assessment tool called

Mild Traumatic Brain Injury: A Serious Problem

The term “mild” traumatic brain injury is very misleading. While the descriptor “mild” typically refers to the severity of the trauma that resulted in the injury, oftentimes in a personal injury context it does not come close to describing the severity of the consequences of the injury. Even though the trauma may be mild, the long term consequences of the injury may be anything other than mild and oftentimes are quite serious.
The vast majority of people who experience a mild traumatic brain injury

What Is A Traumatic Brain Injury?

Traumatic brain injuries typically involve transient periods of some type of neurological dysfunction which can range from brief periods of confusion or dizziness to headaches and/or seizures, sometimes involving nausea. The term concussion is oftentimes used interchangeably with the term “mild traumatic brain injury” or MTBI. The Quality Standards Subcommittee of The American Academy of Neurology has recognized that concussions may occur without the loss of consciousness. There are three grades of concussions according The Academy of Neurology. A Grade 1 concussion involves transient

Aggravation Of Pre-Existing Injuries

In our trial practice we are often presented with cases where the client had a pre-existing medical condition which was aggravated by an accident. As an example, someone can have asymptomatic degenerative disk disease, be involved in an automobile collision and thereafter begin to experience symptoms of pain because of the injury to their neck or back. Someone can have any asymptomatic pre-existing condition, which is aggravated by the trauma from an accident, which causes the pre-existing condition to become asymptomatic. Obviously, the issue in

Saying No To Clients: The Requirements Of Professionalism

There is one duty that a lawyer owes to his client and that is to be truthful with them. In many cases clients need counseling and need it badly. Sometimes clients do not want to hear the truth and take pains to avoid it. Oftentimes clients will turn on their attorneys when the attorney tries to tell them the truth of their situation. In such circumstances the client will accuse the lawyer of not being zealous in his or her representation or not believing in

High Speed Pursuits For Stolen Vehicles: Are They Justified?

When the police encounter a stolen vehicle and attempt to stop it with their blue lights and the driver takes off, the question is whether the public is well served when the police engage in a high speed pursuit thereafter. Clearly the suspect wishes to escape apprehension and is willing to travel at high speeds endangering the lives of the public. The only way they will be apprehended is if the police are successful during their pursuit in running them off the road, using stop sticks or otherwise blockading them. During the pursuit, however, the entire public is endangered and it is quite likely that as the speeds get higher and higher and the offender becomes more and more desperate at escaping apprehension the dangers will increase and tragedy to innocent third parties may result.
We see in these cases often where third parties are killed or injured during these pursuits. Is it worth a human life to capture a suspected car thief? Most car thieves are not caught through high speed pursuits but rather as a result of traditional law enforcement investigations. The few who are engaged in high speed pursuits, if they are allowed to escape, will hardly add to the number of those who are not immediately apprehended for their crimes. However, in order to immediately apprehend the suspected car thief during a high speed pursuit, the public has to be exposed to the possibility of death or serious injury. We raise the question again, is it worth it? Is the death of one or more worth it to apprehend a suspected car thief?
A case which happened on September 4, 2012, in California is illustrative of the dangers in these areas. The police were chasing a teenager for suspected car theft. The police asked for backup. While one of the patrol cars was attempting to join the pursuit, that second patrol car ran over and killed an innocent pedestrian. Thus, in order to immediately apprehend a 17-year old car thief, a pedestrian was killed during the pursuit. Was it worth it? Ask the family of the innocent pedestrian their opinion on this subject and the answer will be obvious.

Settling Serious Injury Cases Out Of Court

In many car accident and personal injury cases, clients often wish to “settle out of course” so as to avoid the stress, anxiety and uncertainty of a jury trial. In many cases this is entirely possible and the client can still achieve a settlement that approximates the fair value of their case. However, in a certain number of cases, settlement offers pre-trial may not constitute adequate compensation for the damage inflicted and thus a jury trial may be a necessity. Sometimes, despite the

Structured Settlements For Minors

With today’s low interest rates, sometimes it makes little or no sense to structure a portion of a personal injury settlement. If a case settles for a particular amount, it is always advisable to consider whether structuring a portion of the settlement money into an annuity by way of a tax free investment might be in the best interest of the client. When minor children are involved, sometimes investing in a long term annuity can not only protect the corpus of the funds but

Atlanta Truck Accident Laws and How They Impact Your Case

Truck accidents are among the most severe and complicated motor vehicle collisions on Georgia roads, especially in Atlanta, where heavy traffic and commercial transport routes intersect. The combination of a truck’s massive size, long stopping distances, and potential for catastrophic damage means these incidents often result in serious injuries, costly property damage, and complex legal challenges.

If you have been involved in such an accident, understanding Truck Accident Laws in Atlanta is crucial. These laws will determine how liability

is established, how damages are calculated, and how you can pursue justice and compensation. This guide explains the key legal rules, deadlines, and procedures you need to know — and how they can directly affect your case.

Understanding the Basics of Truck Accident Laws in Atlanta

Truck accident cases in Atlanta fall under both Georgia state law and federal trucking regulations. This dual layer of rules makes these cases more complex than standard car accidents.

  • State Laws: Georgia follows a fault-based system for accidents. This means the person or party responsible for causing the accident is liable for damages.
  • Federal Regulations: The Federal Motor Carrier Safety Administration (FMCSA) regulates commercial trucks operating in interstate commerce. These regulations cover driver qualifications, service hours, vehicle maintenance, and cargo limits.

Truck accident attorneys must navigate both sets of laws to build a strong case.

Key Georgia Truck Accident Laws You Need to Know

Several specific Truck Accident Laws in Georgia influence how your case will unfold:

a) Comparative Negligence Rule

Georgia applies a modified comparative negligence rule. You can recover compensation even if you are partially at fault, as long as you are less than 50% responsible for the accident. However, your compensation will be reduced by your percentage of fault.

Example: If you are awarded $200,000 but found 20% at fault, you will receive $160,000.

b) Statute of Limitations

For personal injury claims in Georgia, including truck accidents, you have two years from the date of the accident to file a lawsuit. For property damage, you have four years. Missing this deadline usually means losing your right to seek compensation.

c) Mandatory Insurance Requirements

Georgia requires commercial trucks to carry higher minimum liability coverage than passenger vehicles due to the potential for extensive damage. Depending on the type of cargo and whether the truck is operating interstate, coverage minimums can range from $300,000 to $5 million.

d) Reporting Requirements

If the accident involves injury, death, or property damage exceeding $500, you must report it to law enforcement immediately. Failing to report can jeopardize your case.

Federal Regulations Affecting Atlanta Truck Accident Cases

In addition to Georgia’s Truck Accident Laws, federal trucking regulations play a major role in determining liability:

  • Hours-of-Service Rules: Truck drivers have strict limits on how many hours they can drive without rest to prevent fatigue-related crashes.
  • Weight Limits: Overloaded trucks are more likely to cause accidents and may violate federal and state limits.
  • Maintenance and Inspection Requirements: Trucks must undergo regular inspections, and maintenance records are critical evidence in accident cases.
  • Driver Qualifications: Drivers must meet specific training and licensing requirements to operate commercial vehicles.

If a trucking company or driver violates these federal rules, it can significantly strengthen your case.

Who Can Be Held Liable Under Atlanta Truck Accident Laws?

One of the complexities of truck accident claims is that multiple parties may share liability, including:

  • Truck Driver: If negligence such as speeding, fatigue, or distracted driving caused the crash.
  • Trucking Company: For improper hiring, training, scheduling, or failure to maintain vehicles.
  • Cargo Loaders: If improperly secured cargo caused the accident.
  • Manufacturers: If a defective truck part contributed to the collision.

Determining fault under Truck Accident Laws requires a thorough investigation, often involving accident reconstruction experts.

How Truck Accident Laws Impact the Evidence in Your Case

The laws in Georgia and federal regulations shape the type of evidence you can gather and use:

  • Black Box Data: Commercial trucks often have electronic logging devices (ELDs) that record speed, braking, and driving hours.
  • Driver Logs: Can reveal hours-of-service violations.
  • Maintenance Records: May show negligence in vehicle upkeep.
  • Surveillance Footage: Traffic or business cameras can provide visual evidence of the accident.

Your attorney can use legal tools such as subpoenas to obtain this evidence before it is destroyed or altered.

The Role of Negligence in Atlanta Truck Accident Cases

Under Georgia Truck Accident Laws, negligence must be proven to win your case. This involves showing:

  • Duty of Care: The truck driver and company had a legal obligation to operate safely.
  • Breach of Duty: They failed to meet that obligation.
  • Causation: Their actions directly caused your injuries.
  • Damages: You suffered losses such as medical bills, lost wages, or pain and suffering.

Negligence can include speeding, distracted driving, overloading cargo, or failing to maintain the vehicle.

How Truck Accident Laws Affect Your Compensation

Your potential settlement or verdict will depend on how Truck Accident Laws apply to your case. Damages in Atlanta truck accident cases can include:

  • Economic Damages: Medical expenses, lost income, rehabilitation costs, and property damage.
  • Non-Economic Damages: Pain and suffering, emotional distress, and loss of enjoyment of life.
  • Punitive Damages: Awarded in cases involving gross negligence or reckless behavior, such as drunk driving.

Since commercial trucks typically carry large insurance policies, settlements can be substantial — but insurance companies will fight aggressively to limit payouts.

Common Challenges in Atlanta Truck Accident Cases

Even with clear Truck Accident Laws, victims face challenges such as:

  • Multiple Defendants: Cases involving several liable parties require strategic coordination.
  • Insurance Company Tactics: Adjusters may attempt to shift blame or offer lowball settlements.
  • Evidence Preservation: Trucking companies may legally destroy records after a certain time, so acting quickly is essential.
  • Jurisdiction Issues: If the truck operated interstate, federal laws and courts may come into play.

Steps to Protect Your Rights After a Truck Accident in Atlanta

To maximize your chances of a favorable outcome under Truck Accident Laws, you should:

  • Call 911 and seek medical attention immediately.
  • Document the Scene with photos, videos, and witness contact information.
  • Avoid Statements to insurance adjusters until you consult an attorney.
  • Contact a Truck Accident Lawyer experienced in Georgia and federal trucking regulations.
  • Preserve Evidence such as medical records, bills, and communication with insurers.

Why You Need a Lawyer Familiar with Truck Accident Laws

Truck accident cases are not the same as car accident claims. They require an attorney who:

  • Understands both Georgia and federal Truck Accident Laws.
  • Knows how to investigate trucking companies and obtain vital evidence.
  • Can calculate the full value of your damages, including long-term care needs.
  • Has experience negotiating high-value settlements or taking cases to trial.
