Lee Gutschenritter and Gary Thompson recently authored an article which was published in the GTLA Verdict Magazine. This publication is distributed to trial attorneys throughout the State of Georgia. The article discussed the duty of care required by drivers of "emergency vehicles" under Georgia law. In many cases, innocent third-party victims are injured or killed during a police chase as a result of a collision with a police car or a fleeing suspect. In their article, Lee and Gary discuss the duties owed by these emergency responders to the motoring public, and explore the circumstances in which the emergency responder (usually a government entity such as a county or municipality) may be held liable for causing harm.
